  摘 要

  十八大以来,我国各级纪检机关坚持有腐必反、有贪必肃,以零容忍态度严惩腐败、以持之以恒的决心纠正四风,统筹协调形成反腐败整体合力,形成依纪依法高压反腐的新常态,取得了党风廉政建设与反腐败斗争的伟大成绩,但受纪检监察双重领导体制的影响,纪检监察机关存在职能泛化、方式固化、作风异化和功能弱化、人事待遇化等问题,严重影响反腐败工作成效。改革纪检监察体制成为破解当前反腐败体制障碍的必然选择。就改革路径而言,无论是实行垂直管理模式,还是提高地位模式,抑或组建大一统的反腐败专门机构模式,都是在克服纪检监察双重领导体制弊端、增强监督主体相对独立和权威性,但囿于上述模式各自本身的局限性,都无法有效破解当前反腐败体制障碍的现实难题。在不突破党对纪检监察机关领导体制的大前提下,深化“三转”体制改革,增强监督主体的相对独立,完善巡视制度的独特优势,增强法治思维与法治意识,遵循国家治理的价值规律和中国特色腐败治理体系的内在逻辑,才是纪检监察体制改革顺应国家治理体系和治理能力现代化发展不可逆转的现实路径,唯此才能为新常态下的反腐工作提供体制机制保障,使之适应社会主义现代化建设和党风廉政建设与反腐败斗争的需要。

  除导论和结语,本文共分为四章。第一章探讨我国纪检监察机关体制改革的基础理论问题。通过对纪检监察的基本概念阐释推导出纪检监察管理体制改革的基本含义,分析十八大以来反腐新常态,对新常态下纪检监察工作的新变化进行研判,得出纪检监察体制性问题呼唤得到根本性解决的结论。

  第二章深入分析当前纪检监察管理体制的局限性。由于体制障碍,当前纪检监察工作呈现出职能泛化影响专业性,功能弱化影响权威性,方式固化影响效率性,作风异化影响廉洁性,人事待遇化影响效能性问题,通过深入分析问题存在的原因,明确了纪检监察管理体制改革的必要性。

  第三章探讨改革我国纪检监察管理体制的几种模式及各自特点。“垂直管理模式”、“反腐败专门机构模式”、“强化地位模式”均囿于模式本身的不足,不是当前纪检监察体制改革的合适路径,“三转”改革模式回归党章、聚焦本职,是契合当前实际的改革出路,但不能一蹴而就,改革过程中涌现出许多新问题有待解决。

  第四章紧扣上文,提出深化纪检监察管理体制改革的对策建议。要改进措施深化“三转”改革,要完善巡视制度这一反腐利器,充分发挥其在纪检监察工作中的独特优势,要建立健全适应纪检监察体制改革的相关制度,要在法治的轨道上深化改革,要从国家治理的基本价值上来推进改革。

  ABSTRACT

  Since The Eighteenth National Congress of the CPC, the Disciplineinspection and supervision organs at all levels in China adhere to rot willreverse, there will be corruption Su, with a zero tolerance attitude punishcorruption, to persevere is determined to correct the four winds,co-ordination formed the overall anti-corruption force, the formation ofthe discipline in accordance with the law of anti hypertension of the newnormal, the great achievement of made of honest government and thefight against corruption. At the same time, by the impact of the dualleadership system of discipline inspection and supervision, disciplineinspection and supervision organs exist working face spread too wide,function generalization, curing, the style of alienation and the weakeningof the function such as phenomenon, a serious impact on theeffectiveness of anti-corruption work. Reform the system of disciplineinspection and supervision is the inevitable choice to crack the currentanti - corruption system barrier. The choice of reform path, whether it isthe implementation of vertical management mode, or improve the statusmodel, or to form a unified anti corruption specialized agencies, is toovercome the drawbacks of the dual leadership system of disciplineinspection and supervision, enhance the supervision of the main body ofthe relative independence of beneficial exploration, but confined to thedefects of the model itself, are not sufficient to break the currentanti-corruption institutional barriers to the reality of the problem. In donot break the Party leadership system of discipline inspection organsunder the premise, to deepen the “three” reform, strengthen supervisionof the main body of the relatively independent, improve the inspectionsystem of the unique advantages, enhance the thinking of rule of law andthe rule of law consciousness, is reform of discipline inspection andsupervision system conform to the practical path of national governancesystems and governance capacity modernization development ofirreversible, only in this way can anti-corruption new normal providemechanism to protect the system, so as to adapt to the socialistmodernization construction and building an honest and cleangovernment and anti-corruption struggle.

  In addition to the introduction and conclusion, the paper is dividedinto four chapters. Chapter 1 discusses the basic theoretical issues of thereform of the discipline inspection and supervision system in China.

  First through of discipline inspection and supervision of the basicconcept of interpretation derived discipline inspection and supervision ofthe management system reform of basic meaning, then on the historicaltrace and the reform of China's discipline inspection and supervisionmanagement system gave a general review. Finally for eighteen yearsnew anti-corruption norm analysis, especially for the new normal thenew changes of the discipline inspection and supervision work judgedthat the discipline inspection and supervision system call has beencompletely solved.

  The second chapter is a thorough analysis of the limitations of thecurrent discipline inspection and supervision management system.

  Owing to the drawbacks of the system, the discipline inspection andsupervision work showing function generalization of professional andweakening of the function of authoritative influence, curing methods onthe efficiency, the style of the alienation effect of integrity, personneltreatment affect performance problems and by the deep-seated reasonsfor the solution to analyze the necessity of the reform of themanagement system of discipline inspection and supervision.

  The third chapter discusses the reform of our country's disciplineinspection and supervision system of several modes and characteristics.

  “Vertical management model” and “anti corruption specialized agenciesmode”, “strengthen the status model” are limited to the model itself, notthe discipline inspection and supervision system in the right path, “three”reform model is fit the actual reform way, but not a pinch, in the processof reform emerged many new problems must be solved.

  The fourth chapter is closely bearing on the chapter, and putsforward the countermeasures and suggestions for deepening the reformof the discipline inspection and supervision system To improvementmeasures to deepen the “three” reform, to improve the inspection systemanti-corruption tool in the discipline inspection and supervision work inthe unique position, to fully establish adapt to the discipline system inthe relevant system, to in the orbit of the rule of law to deepen reform,we must from the basic value of the national governance up is pushedinto the reform.
