摘要
法律现代化是社会发展进程在法律层面上的体现，是法律从传统向现代的一个转变过程。世界各国法律现代化的主流发展模式以其推动力量的不同可以划分为两种。一种是在社会内部力量推动下引起的法律从传统向现代的转型，即社会推进型（内源型）模式；另一种是在一国政府的主导下，由外部较先进的法律制度通过对本国较落后法律制度的冲击而发生的法律转型，即政府推进型（外发型）模式。本文通过对第一种模式的典型代表一一西方社会法律现代化进程的具体分析，阐述了西欧社会推进型法律现代化模式的具体内容和表现形式，探究其存在的社会背景和发展方向，分析了市民社会对西欧法律现代化的作用，同时比较了政府在不同模式下的功能表现。将西欧社会和政府的作用机理，结合到我国的政府主导型进程中。探索我国法律现代化进程的发展脉络和改革方向，将政府与社会力量有机结合，通过平衡政府和社会二者在法律现代化中的地位和作用，确立法律现代化的合理道路，推动我国法治现代化建设，实现国家的法治目标。

Abstract
The legal modernization is the embodiment of the social development process in the legal level,which is a developing transformation process of law from the tradition to the modern. There are twomain types of modernization mode in the world from the point of view of the main driving force oflegal modernization. One is society-driven （the inner dynamics mode） mode, which is driven by thesocial inner power; another is government-driven （the exterior impact pattern） mode,which is causedby the impact of foreign advanced legal system on their backward legal system. This articleexpounds the specific content and form of legal modernization of Western Europe which is pushedby social model, explores the social background of its existence and development direction andanalyzes the role of civil society in European law modernization by analyzing the legalmodernization of Western society, which is a typical representative of the first mode. At the sametime, this paper compares the function of government in different mode and applies the mechanismof Western European society to the government-driven mode of our country. We should establish areasonable road to promote the construction of the legal modernization of China, to achieve the aimof the rule of law by exploring the direction of development and reform of the legal modernization ofour country, combining the force of government and society, balancing the position and role ofgovernment and society in the legal modernization.
