摘 要
死刑问题是刑法学理论中一个重要的问题，可谓刑法理论大厦中浓重一笔。对这个理论问题的观点与抉择折射出一个国家刑罚观念、人权状况、现实状况。但长期以来关于这个问题，中外刑法学家却争论不休，有关死刑存废的学术观点众说纷纭。对此笔者认为，我国目前不具备废除死刑的条件，理性的抉择是严格限制死刑的适用。本文指出我国死刑的发展趋势是严格限制死刑逐步走向废止的道路，且在简要阐述死刑的理论认识，解析死刑存废的相关学说的基础上，探讨了我国死刑制度的现有状况，进而提出限制死刑司法适用的趋势，并进一步指出了司法适用方面的对策。其意从审判程序的健全、司法理念的更新和转变、死缓制度的完善等方面达到限制死刑适用的目的，推进我国死刑废止的进程，彰显法治文明的理念。

Abstract
Death penalty is an important issue in criminal law theory, it is so important in criminallaw theory mansion that the views and the choice on this issue reflect the concept of onecountry's penalty situation of human rights and the reality. For a long time, criminal lawexperts at home and abroad debate about the death penalty abolition. In my opinion, it doesnot have the conditions for abolishing the death penalty. Rational choice is to strictly limit theapplication of the death penalty. This paper points out the trend of the death penalty in ourcountry is restricted to death penalty and transition to abolish it. Based on the brief descriptionof the theoretical understanding of the death penalty and abolition of Death Penalty relevantanalytic theory, we discussed the situation of death penalty in our country and Proposed torestrict judicial application of the death penalty and further point out the judicial applicationof countermeasures. We purposed from integrity of trial proceedings, updates and changes ofjudicial philosophy and reprieve perfection… then reached the restrictions applies of deathpenalty, promoting the process of China's death penalty abolition and highlighting the conceptof the rule of law and civilized.
