摘 要
近几年来，环境污染问题日益严重，传统能源消耗带来经济利益的同时，环境也付出了沉重的代价。可再生能源凭借其几乎零污染的特点受到青睐，太阳能光伏发电也逐渐受到关注。我国拥有十分丰富的太阳能资源，但是太阳能转化为电的过程仍存在诸多障碍和不足。
许多法律保障措施，监管措施和经济激励措施的不成熟也对光伏发电产业发展造成了不良影响。因此，需在新的经济发展形势下完善我国的光伏发电促进法律机制，以推动太阳能光伏发电的发展。
本文主要分为以下五个部分：
第一部分，从光伏发电法律机制的概述着手，明确法律机制的涵义，界定法律机制与相关概念的辨析，提出光伏发电促进法律机制是指在有关规定太阳能开发利用法律法规的指导和规范下，国家机关、企业、社会组织、公民等主体依法主张权利，履行义务，调整相互之间的法律关系，以便尽可能地开发太阳能能源，提高能源利用效率，保护和改善环境，实现可持续发展，保障经济利益和环境利益协调发展整个运行过程的综合原理。
第二部分，提出我国光伏发电促进法律机制的现状并揭示出其问题，分别从总量目标措施、上网电价激励措施、发电费用分摊措施和经济激励措施四个方面阐释现状，然后从光伏发电立法、光伏发电法律保障和光伏发电产业监管方面总结了其问题。
第三部分，从世界上光伏发电相对发达的几个国家介绍其发展概况，包括国家目标规划机制、电价机制和激励机制三方面。以德国、美国和英国三个国家为例，分别列举各个国家有关太阳能光伏发电的立法情况和政策措施，最后对比我国光伏发电开发利用的实际情况，吸取有利的借鉴意义。
第四部分，结合我国实际情况，提出我国光伏发电促进法律机制的完善对策。主要包括：健全法律依据，细化专门法规和完善配套法律法规。完善总量目标措施、财政补贴措施、固定上网电价和经济激励措施等保障措施。确立统一的管理机构和建设完备的监管体系。
第五部分，是本文的结论部分，通过对我国光伏发电促进法律机制的初步探讨和分析，发现存在的问题，对比光伏发电发展成熟国家的情况，我国应在现有法律法规的前提下，细化《可再生能源法》中光伏发电的具体规定，同时完善配套经济激励措施，明确各项规章实施主体、实施程序，以期更好的开发利用光伏发电。

ABSTRACT
The consumption of traditional energy has contributed to thedevelopment of economy; on the other side, it also has seriously pollutedthe environment in recent years. With the feature of nearly non-pollution,Renewal Energy has been paid more attention as well as solar photovoltaic（PV）。 China has a large storage of solar energy which has not been fullyused for lacking of adequate legal protection system, supervision systemand economic incentives. It also had a negative influence of solar PVdevelopment. Therefore, it is necessary to improve the legal mechanism ofsolar PV under the new economic conditions.
In general, this dissertation has been divided into five parts:
The first part concerns about definition of legal mechanism and legalmechanism of solar PV. After comparing with the legal mechanism andrelevant definition, we define the legal mechanism of solar PV is such akind of mechanism that governmental agencies, corporations, socialorganizations and citizens allege for their rights and fulfill their obligationsunder the current relevant laws and regulations. This mechanism willmoderate their relations in order o make a better development of solarenergy and increase energy use efficiency, and finally protect and improvehe environment.
The second part introduces the condition of legal mechanism of solarPV and current issue that needs to be improved. The third part introducesthe development of solar PV in other countries, which will take Germany,United States and UK as examples, and will introduce their laws andregulations enactment. After comparing with the fact in China, thedissertation will give suggestions on how to learn from abovementionedcountries.
The fourth part gives suggestions on how to improve the legalmechanism of solar PV in China based on Chinese current conditions. Weshall make special solar PV laws and regulations, make measures onquantum mechanism, and take fiscal subsidies etc. Meanwhile, an unitiveorganization and supervision system is necessary.
The fifth part is the conclusion of the dissertation. After study andanalysis of the legal mechanism of solar PV of China, we have found theproblem and will improve them with reference to beneficial experience ofother countries.
This dissertation has used a lot of study mechanism, which includesliterature research method, method of comparative research, comprehensiveanalysis method and method of induction.
