中文摘要
人道主义干涉一词由来已久，早在 14 世纪时就已经出现。目前在国际社会上也是一个比较热门的话题。本文阐述了人道主义的含义、干涉的含义以及人道主义干涉的含义，罗列出了人道主义干涉在《联合国宪章》中的有关规定，列举了科索沃战争和利比亚战争这两个案例，并分析了传统的人道主义干涉和现代的人道主义干涉。通过这两个案例提出了人道主义干涉的缺陷，其中包括侵犯不得干涉主权原则，侵犯人权，侵犯禁止使用武力和武力威胁原则。结合上诉缺陷最后提出了人道主义干涉的完善。例如，明确人道主义干涉的限度，完善联合国安理会关于人道主义干涉的调查和决策机制，明确司法在处理国际事件中的地位，建立监督程序和惩罚制度，明确人道主义干涉的条件，严格限制人道主义干涉的管辖权。

Abstract
The word humanitarian intervention has a long history, which have appeared sincefourteenth Century. It also has always been a hot topic in today's internationalcommunity. This paper expounds the meaning of the humanitarian, the interference andthe humanitarian intervention and lists the humanitarian intervention in the relevantprovisions of the charter of the United Nations at the same time. This paper takes theKosovo war and the war in Libya for example, analyzing the traditional humanitarianintervention and modern humanitarian intervention. The two cases presented the defectsof the humanitarian intervention, including great interference sovereignty principle,human rights have been infringed, violated the principle of non-interference, violatedthe ban on the use of force and threat of force principle. Combined with the appealdefect finally put forward the improvement of the humanitarian intervention. Forexample, to clear the limits of humanitarian intervention, to perfect the UNsecurity council on humanitarian intervention research and decision-making mechanism,to clear legal status in handling international affairs. to establish procedures forsupervision and punishment system, to clear the condition of humanitarian intervention,to make the jurisdiction of humanitarian intervention has a strict limitation.
