到案措施是公安机关现场处置时的有力武器，也是案件办理顺利进行的保障。由于法律规定的不明确、不合理，到案措施适用过程中存在不少问题。一方面到案措施不能适应警察现场处置及办案的需要；另一方面到案措施使用过程中致使公民自由、权利、财产被侵害的事件时有发生。为了保证警察现场处置的正当需要，又能最大限度的维护相对人的权利，需要对到案措施进行研究探讨。
本文分引言和正文，正文分为四个部分。本文试图通过对警察现场处置时到案措施的适用予以规范，既保障警察依法处置，顺利办理案件，又能保障人权，维护相对人的合法权益。
第一部分是到案措施的适用范围。通过列举我国对到案措施的立法规定及实际应用情况，分析存在的问题，提出整合到案措施的构想。
第二部分是到案措施的适用条件。通过与英、美、德、法、日等国适用条件的比较，分析其中的优劣，提出严格适用条件的建议。
第三部分是到案措施的适用程序。通过分析到案措施程序运行原则，指出各个程序环节中存在的问题，提出细化适用程序的设想。
第四部分是到案措施的救济途径。通过审视到案过程中人权保障状况，分析原因，提出强化监督、救济的各项措施。

Abstract
Attendance measures are the powerful arms of the public security organ in the sitedisposal and the guarantee for the smooth progress of case transaction as well. Due to theundefined and irrational legal provisions, there are lots of problems in the application ofattendance measures. On one hand, attendance measures fail to meet the police's demandin terms of site disposal and case handling; on the other hand, the events that civil freedom,right and property are infringed frequently occur in the utilization of attendance measures.
Thus, it is necessary to probe into attendance measures so as to guarantee the police'srational demand of site disposal and meanwhile furthest maintain the right of counterpart.
This paper is classified into the introduction and the body which is divided into fourparts. This paper attempts to specify the application of attendance measures in the sitedisposal by the police, aiming to ensure the police's disposal is in conformity with legalprovisions and the case is handled smoothly and meanwhile assure human rights andmaintain the legitimate interest of counterpart.
The first part is the application range of attendance measures. Existing problems willbe analyzed through enumerating legal provisions on attendance measures in China and thepractical application situation and the conception on integrating attendance measures isalso proposed.
The second part is about the condition for the application of attendance measures. Bycomparison with the application conditions in UK, US, German, France, Japan and so on,disadvantages and advantages are analyzed and suggestions on strict application conditionsare put forward.
The third part is the application procedure of attendance measures. Based on theanalysis of the operation rule of attendance measure procedures, problems in everyprocedure link is pointed out and the conception on refining the application procedure isalso presented.
The last part is the remedy approach to attendance measures. Through the survey ofhuman rights protection situation in the attendance, reasons are explored and variousmeasures on intensifying the supervision and the remedy are suggested.
